Our Service

Fladgate’s projects and infrastructure team brings together corporate, construction and finance lawyers with expertise and experience in the sector to advise on the full spectrum of works and services contracts, on a transactional, advisory or contentious basis.

Our lawyers advise on major civil engineering projects in the UK and abroad and also have particular experience in the procurement and construction of major sports stadiums in the UK. Our team is particularly adept at advising clients on project management and troubleshooting, and has extensive experience of assisting clients on non-contentious and contentious resolutions and PFI disputes are a particular forte.

We are able to advise on early stage issues, including procurement, public procurement, competition law and State Aid matters. We also advise on health and safety issues and defend health and safety prosecutions. Fladgate clients include UK and international contractors and secondary and primary-market investors in a range of sectors, including transport, hospitals, schools, defence, social housing, facilities management, utilities and waste management.

FAQ

The Private Finance Initiative (PFI) was a public procurement policy in the UK that contracted private firms to complete and manage public projects under public-private partnerships (PPPs). Initially launched in 1992, the PFI’s end was announced in 2018, however existing partnerships will continue to operate indefinitely.

Over 50 English hospitals have been procured under a PPP, and in 2017 there were 172 PFI schemes operating services in the NHS.

Local Asset Backed Vehicles are a way of combining private sector finance and expertise with public sector real estate. The private and public sector bodies combine their assets in creating a corporate entity that is then equipped with land and finances to develop the land in any way that enhances its value, with the profits shared between the private body and the public body.
